It's much more likely they are taken from the same molds as the "legit" Mega Construx toys, if not directly stolen from the assembly line. A big issue with toy production, or pretty much any other consumer product production, in China is that a factory owner can (and they do) "borrow" molds and patterns to make their own production runs of "knock-offs".
I say can "borrow" not because they can necessarily legally do so but because they have physical access to the molds and patterns and more often than not employees of the actual company contracting time in their factory doesn't have an employee physically present at the point of production. And to the second point (stealing from the assembly line) that isn't rare either.
